New October Regulations Set Stricter Safety Standards for Social Housing

From the 27th October 2025, social landlords in England will be legally required to respond quickly to dangerous damp, mould, and emergency hazards under the new Awaab’s Law. This landmark housing regulation, introduced via the Social Housing (Regulation) Act 2023, inserts new repair obligations into social tenancy agreements.

What is Awaab’s law?

The law is named after Awaab Ishak, a two year old child who tragically died following extended exposure to damp and mould in social housing. His death drew attention to the fact that existing housing safety standards lacked enforceable deadlines for landlords to act.

What the Law Requires

Social landlords who fail to comply may face legal action by tenants for breach of tenancy.

Emergency hazards:

  • Emergency hazards, including dangerous damp or mould, must be repaired within 24 hours once identified.

Significant hazards:

  • Social landlords must investigate potential significant hazards within 10 working days of becoming aware.
  • Within 3 working days of completing the investigation, the landlord must provide the tenant with a written summary of findings.

The future of Awaab’s Law:

  • This initial phase focuses on damp, mould, and emergency hazards, with the scope of the law expanding over the coming years to cover further hazards (e.g. structural, fire, electrical faults).
